Our privacy policy is designed to ensure our customers, users and our associates that their data is secure, handled with care and not used beyond each user’s control.

Our duty of care is carried out seriously, professionally and most importantly safely. We have no purpose in exploiting data beyond any means necessary.

Definitions and interpretation



In this privacy policy, the following definitions are used:

‘Associates’:
This is a third-party that may work alongside awesome. in order to carry out a service or product for a customer.

‘awesome.’ or ‘us’ or ‘our’ or ‘we’:
The use of these terms refers to the service and product provider of who this policy is presented by. The terms cover both We are Awesome Ltd, and We Are Awesome Digital Ltd when referred to. We Are Awesome Ltd is the main business group and carries out branding and content services. We Are Awesome Digital Ltd carries out digital services and provides the ‘products’ of which it has full IPR of. Both companies work alongside each other and have dedicated purposes for securely holding user data, which will be defined in the sections of this policy.

‘Cookies’:
This is a small text file placed on your computer by our website (www.weare-awesome.co.uk) when you visit certain parts of the website and/or when you use certain features of the Website. Details of the cookies used by our website are set out in the Cookies section of this policy.

‘Customer’:
This is referring to a third party that is enquiring and/or purchasing our services or products. This includes visitors to our websites.

‘Data’:
This is the information relating to you, which you will provide and be obtained by awesome.

‘End User’:
This is a third party that visits a Customer’s website, and whose data will be stored within our Customer’s account, when using our products. The use of the End User’s data is liable to our Customer.

‘Products’:
These are the types of sale for customers relating to accessible articles provided by awesome. which include frisbee™ and playground™ web platforms. These products will require user access once purchased.

‘Services’:
These are types of sale for customers relating to time-invested work by awesome. which include, branding, content and digital works.

‘User’:
This is referring to a third party that is using our services or accessing our products. This includes users of our websites and communication portals.

‘Website’:
These are the websites owned by awesome. including: weare-awesome.co.uk, builtonawesomeness.co.uk, frisbeeapp.co.uk and playgroundapp.co.uk, and any sub-domains of these sites unless expressly excluded by their own terms and conditions.

‘You’, ‘Your’, or ‘Yours’:
Referring to the third-party that is reading this policy and that the policy applies to.

This policy does not cover Customer’s or User’s right to their data when using our products or websites. Customers and Users will be required to provide their own privacy policy and terms & conditions when required, whilst using our services and products. Customers and Users will need to adhere to our privacy policy and demonstrate to their customers/users that the principals in this document are followed at all times.

Data that we collect and how we obtain this



Associates and Customers:
- Contact Information: We will request your name, email address, telephone number and other required information (such as registered business address) when liaising with you about a new enquiry, placing an order for one of our services or products, filling in a services or product agreement/contract, or when submitting a web form via our website.

Users:
- Account information: We will require your email, name, telephone number and website URL when using our services and products.

End Users:
- Contact Information: Information such as name, email, telephone number and other required information (such as registered business address) captured via our Customer’s website or web-capture method will be stored within our product database, accessible only to the specific Customer account that it is captured through.

- Activity:
Analytics will monitor End-User traffic on our Customer’s website or related web-articles which use our products to operate.

It is important to us that we obtain the data stated above via the following methods:
- Organic enquiries to our business contact details via email, postal and telephone contact
- Website form capture (i.e. contact form)
- Email communication relating to services and products (i.e. account registration email)
- Written/Digital form submission (i.e. service agreement supply from customer)
- Support enquiry (i.e. help-desk enquiry via our product websites/web portal)

Where possible, we will require that before the data is provided to us, that the Associate, Customer or User will provide consent to this by one of the following methods:
- Providing a Signature of approval with date mark
- Ticking a consent to privacy box
- Opt-in/out selection
- Giving verbal consent over the phone
- Providing written/typed electronic submission via email upon request by awesome.

We will not store any visible data that is sensitive or vulnerable to malicious activity, such as:
- Passwords
- Card Payment details
- Non-required personal details (unrelated to services)

How we use the data collected



Protection of data is extremely important to us, and it is within our main interest to ensure that your information is not used beyond control. Across our services and products, there are variable way that your data helps us operate each matter in hand and below is a rundown of how we use your data accordingly:

- Communication:
When liaising with Associates, Customers and Users, we will require a form of contact in order to discuss any business-related matters with them. The most useful contact information to be obtained is Name, Email and Telephone details. We will require these basic communication details from our Associates, Customers and Users whilst services and products are being carried out. These will be used for our internal usage only and these details will not be accessible, resold, or handed-over to any third-parties that may contact you without your consent.

- Sales and Agreements:
We will require Associates, Customers and Users to provide the pertinent information for our records in order to finalise a sale of services or products and to finalise an agreement of terms relating to the sale. All sales and agreement related data is stored securely for a minimum of 12-months from point of issue.

- Services:
In order to improve and manage our services, we may access your data records internally to review services related to you. The access of this data may be to look at an existing case study regarding our services for review and scoping improvements for future service matters. At no point will your data be tampered with or amended when reviewing in this situation.

- Products (user accounts):
Our role as generating user accounts and storing user’s data is that of a Data Controller. We are required to store the pertinent contact information for our users which are securely stored in our records. The data provided by you for your account usage is not distributed to other unrelated users of our products (i.e those outside of your organisation). Each user of our product will require a password to access their account, of which this will be confidential to the user alone. All user passwords are encrypted, and we do not actively store any personally identifiable data. We ask our users not to add any such data into their accounts within our products. Users of the products will have access to support tickets and messaging tolls that connect with us, in order to manage and perform maintenance on the product running, issues occurred and general account related enquiries. These support tickets and messages will be logged within the user account and our records for the duration of our users account activity within the products provided. This data will not be shared beyond these areas.

- Products (usage):
Our role with providing users with access to use our products is that of a Data Processor. This means that we provide our users with product to use for data storage and capture of their end-users. The products have the required security provisions in place to ensure that the users of the products can safely manage and use the features with their end-users and practice their own Data Controller policies to ensure that their end-users data is secure at all times. The data captured by our product users that display their end-user’s data and activity will not be stored in our personal records, only the user accounts within our products. We may use the analytics of end-user activity on our user’s websites or related web-articles to report back to our product users (when these features are subscribed to by our Customers for their user account), however we will not distribute end-user information beyond our user’s account (within our products). Users will have access to communication tools (i.e. email marketing, messaging), contact database and CRM functionality that relates to their end-user’s data. This will not be accessed by us for usage outside of our users account, and our users must practice their own privacy policy between them and their end-users.

- Maintenance and Support Work:
When required, we will need to access accounts for Associates, Customers and Users in order to carry out maintenance and support work. Associates, Customers and Users will always be notified of these types of work; they will be updated on ongoing works to improve services and products via our roadmap portal (on applicable services and products) or direct updates via their contact details provided. When work is due to be carried out on a dedicated account relating to an Associate, Customer, or User, they will be contacted directly.

- Marketing:
We do like to keep our Associates, Customers and Users updated with news about our business, services and products, offers, and general updates on activity that may be beneficial to them. Before adding you to this list of contacts, we will ask for your consent in a direct method (email/written format) of which you will have the option to opt in or out to this service. The data we access is your name and email address for this service. If you are accessing our marketing, at any time, you can unsubscribe/opt-out of these services if no longer interested in receiving them.

Your rights to managing your data



At any given time, our Associates, Customers and Users have the right to amend, update, or withdraw their data that is stored in our records.

Updating your data records:

Updating your data records may include one of the following changes – adding a new data record (e.g inviting a new staff member to join your account within our product – this action will require the new data user to accept and adhere to these terms when adding their data to our records), changing status of data (e.g. enabling email marketing to your contact profile, changing an account level – staff to admin, for example etc), or adding a new service or product license to your existing data record. Withdrawing data:

Any requests to withdraw your data will be required in writing which are to be made to:

Requesting data to be removed from our records will have effect on the following matters:

- Purchased service-related records that the data is assigned to: Any works produced for the services relating to the data in question will no longer be stored within our archives/filing system. Any works ongoing that are not finalised at the time of request to withdraw data will need to adhere to termination clause in the service agreement made by both parties before data is removed.
- Subscriptions to products and services: Data withdrawn from our records that will affect ongoing subscriptions to products and services must adhere to the service/product agreement made between both parties before withdrawal as this will cause the subscription to end. If the Data is none impacting of the subscription (i.e the data requested for removal is not an admin or account controller for payments etc) then the data will be removed upon request and the admin(s) and/or account controller will be notified of this change (made by the user in question).

Password details are not possible to be changed via our handling. Passwords can be reset using the prompts within your account portal within our products and following the necessary stages to change them.

Your security



Data security is of great importance to us and to protect your data we have put in place suitable physical, electronic and managerial procedures to safeguard and secure Data collected across online and offline records. If password access is required for certain parts of our products and services, you are responsible for keeping this password confidential.

All active Associates, Customers and Users will be notified of any changes to our privacy terms and these will be immediately posted on our websites and relating documentation where required. All active Associates, Customers and Users are deemed to have accepted the terms of the privacy policy on your first use of our website, products and services, following the alterations made.
